What Mainstay does, what it doesn't do, and the agreement between us when you use it.
Mainstay is a private preparation tool that helps you organize your story, understand your court orders, and assemble materials for review by a qualified human. It is not a law firm. It does not give legal advice. The drafts it helps you create are starting points, not filings.
These Terms of Service ("Terms") are a contract between you and Mansa Merch LLC ("Mansa Merch," "we," "us," or "our") covering your use of Mainstay, including the Mainstay website at mansamerch.xyz, the Mainstay waitlist, and the Mainstay mobile applications when available (collectively, the "Service").
By creating an account, joining the waitlist, or using the Service in any way, you agree to these Terms. If you don't agree, please don't use the Service.
These Terms work together with our Privacy Policy, which describes how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.
Mainstay is an initiative of Mansa Merch LLC, a company incorporated in California, United States. Mainstay is being built as a private, mission-driven tool for parents, grandparents, and guardians navigating family court.

Mainstay is a document-preparation and personal-organization tool. Specifically, the Service helps you:

Mainstay is not a law firm and does not provide legal advice. Using Mainstay does not create an attorney-client relationship between you and Mansa Merch, and your communications with the Service are not protected by attorney-client privilege.

Mainstay uses artificial intelligence to help you structure and organize your content. This includes converting voice recordings into structured records, parsing court orders into plain-language summaries, walking you through form fields, and assembling packets.

To use most features of the Service, you must create an account. By creating an account, you represent that:
You can update your account information at any time from within the Service. If you forget your password, you can request a password reset email from the login screen.
You can delete your account at any time from within the Service. Deletion is subject to a 30-day grace period during which the deletion can be reversed. After 30 days, your account and all associated data are permanently deleted from our active systems, as described in our Privacy Policy.
Everything you create or upload in the Service ("Your Content") remains your property. This includes your voice recordings, records and moments, photos, court orders you upload, declarations and drafts you write, packets you assemble, and any other content you provide. We do not claim ownership of Your Content.
You grant Mansa Merch a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, process, display, and reproduce Your Content solely for the purpose of providing the Service to you. This license exists only to make the Service work. It allows us to:

Mainstay is intended for use by parents, grandparents, guardians, and other caregivers preparing for their own family-court matters. It is not intended for use by attorneys to prepare client materials, by paralegals working under attorney supervision (without separate licensing arrangements), or by individuals attempting to assist others as a paid service.
If you are an attorney, legal aid organization, paralegal, or other legal professional and you'd like to use Mainstay in your practice, please contact us at mainstay@mansamerch.xyz about partnership or licensing options.
Mainstay is available in a free tier and one or more paid tiers. Specific pricing, feature inclusions, and limits for each tier are available in the App Store, Google Play, and inside the Service. Pricing may change; current pricing always applies to new subscriptions and renewals.
All payments are processed through the Apple App Store (for iOS subscribers) or Google Play (for Android subscribers). When you subscribe, the platform store charges your payment method on file and forwards your subscription status to us through a payment management service. We do not see, store, or have access to your credit card number, bank account details, or other payment credentials at any point.
Payment terms, billing cycles, and refund policies are governed by the platform store you used to subscribe. Mansa Merch is not the merchant of record for your subscription; Apple or Google is.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage and cancel your subscription at any time through your Apple ID or Google Play account settings. Mansa Merch cannot cancel a subscription on your behalf; cancellation must be done through the platform store where you subscribed.
If we offer a free trial, the trial automatically converts to a paid subscription at the end of the trial period unless you cancel before then. You will be charged the regular subscription price when the trial ends. To avoid being charged, cancel before the trial ends.
Mainstay's users often face periods of acute financial stress, particularly during active family-court proceedings. We are working on options for short-term subscription pauses during such periods. These options will be available through the Service when ready, subject to Apple's and Google's platform policies.
You can cancel your subscription at any time through your Apple ID or Google Play account settings. After cancellation, you continue to have access to paid features until the end of your current billing period.
Refunds are subject to the policies of the platform store where you subscribed (Apple or Google). Mansa Merch does not directly issue refunds for subscription payments. To request a refund, contact Apple or Google directly:
If you believe you are entitled to a refund for reasons outside the platform store's policies (for example, if our service failed in a way that caused you specific harm), please contact us at mainstay@mansamerch.xyz and we will consider your request in good faith.
You may stop using the Service at any time. You may delete your account at any time from within the Service.
We may suspend or terminate your account if we reasonably believe that you have violated these Terms, particularly the Acceptable Use provisions. In most cases, we will provide notice and a reasonable opportunity to address the issue before terminating. For serious violations (such as content that depicts child sexual abuse, terrorism, or that violates court orders or applicable law), termination may be immediate and without notice.
If we terminate your account, we will provide you with a reasonable opportunity to export Your Content before deletion, except where doing so would conflict with our legal obligations.
On termination, your right to use the Service ends. Provisions that by their nature should survive termination (including ownership of content, limitation of liability, indemnification, and dispute resolution) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MANSA MERCH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Specifically, we make no warranty that:
You acknowledge that family court is complex, that outcomes depend on many factors outside Mainstay's control, and that no preparation tool, including Mainstay, guarantees a particular result.
TO THE FULLEST EXTENT PERMITTED BY LAW, MANSA MERCH, ITS OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION:
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE, IN AGGREGATE, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent applicable law in your jurisdiction prohibits these limitations, they apply to you only to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Mansa Merch, its officers, employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles.
Before filing any formal legal action, please email us at mainstay@mansamerch.xyz describing the issue. We commit to working in good faith to resolve disputes informally. Most disputes can be resolved by direct communication.
If we cannot resolve a dispute informally within 60 days, any remaining disputes between you and Mansa Merch arising out of or related to these Terms or the Service will be resolved through binding arbitration administered by JAMS in Los Angeles, California, under JAMS's then-current Streamlined Arbitration Rules. The arbitrator's decision will be final and binding.
The arbitration will be conducted in English. You and Mansa Merch each waive the right to a jury trial and the right to participate in a class action.
Either party may bring an individual claim in small claims court if it qualifies under the jurisdictional rules of that court.
You may opt out of this arbitration agreement by emailing us at mainstay@mansamerch.xyz with "Arbitration Opt-Out" in the subject line within 30 days of first accepting these Terms. If you opt out, all disputes will be resolved in the state or federal courts of Los Angeles County, California.
You agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. The arbitrator has no power to hear class or representative claims.
The legal language in this document gets dense because it has to. But I want to say something plainly: I'm building Mainstay because I'm in this situation. A court order has been violated in my own family case for over thirteen years, and I know what it's like to need a tool like this and not have one.
The terms above are written to protect you and to protect Mainstay so it can keep helping people. The disclaimers about not being a lawyer, the limitations of AI, the responsibility you take when you file something — those are real and they matter. But they're not there to make Mainstay less useful to you. They're there because being honest about what this tool is and isn't is the only way to build something that holds up.

Your continued use of the Service after the new terms take effect constitutes acceptance of the new terms. Minor changes (clarifications, corrections of typos, updates to links) may be made without separate notice but will be reflected in the "Last updated" date.
